Hytrade

These Terms govern your access to and use of the Hytrade platform (the “Platform”). By using the Platform you agree to them. If you do not agree, do not use the Platform.
Hytrade is charting, analysis and order-routing software for futures markets. It is a tool you operate. It is not a broker, an exchange, a clearing firm, or a custodian; it does not hold your funds and it does not execute trades itself. Orders you place are transmitted to the brokerage account you connect, and that brokerage decides whether to accept them.
Nothing the Platform displays is investment advice, a recommendation, or a solicitation to buy or sell anything. Indicators, signals, strategies, backtests and analytics are computational outputs, not opinions about what you should do. You are solely responsible for your trading decisions.
Trading futures involves substantial risk of loss and is not suitable for everyone. You can lose more than your initial deposit. Past performance, including any backtest or simulated result shown by the Platform, does not indicate future results; simulated results in particular do not account for the effects of real execution, and are prepared with the benefit of hindsight.
When you connect a brokerage account you authorize the Platform to access that account and to transmit the instructions you give it. Your relationship with that brokerage is governed by their agreement, not this one. You are responsible for ensuring your use of the Platform complies with their rules, including any rules imposed by a proprietary trading firm whose evaluation or funded account you connect.
The Platform can place orders automatically on conditions you configure, and can enforce limits you set, such as maximum position size, daily loss, and trade counts. These are conveniences operating on best effort. They depend on market data, connectivity and the brokerage responding, none of which we control, and they can fail. They are not a guarantee against loss, and you remain responsible for every order placed under your account.

We aim for high availability and design for it, but the Platform is provided as is. It may be unavailable for maintenance, or because of a failure in infrastructure, market data or a brokerage. We do not guarantee uninterrupted access, and you should not rely on the Platform as your only means of managing an open position.
The Platform, its software and its design are owned by Hytrade. These Terms grant you a personal, non-exclusive, non-transferable right to use it, and nothing more. Content you create, such as strategies, layouts and annotations, remains yours; you grant us the right to store and process it in order to provide the Platform.
To the maximum extent permitted by law, Hytrade is not liable for trading losses, lost profits, or indirect, incidental, special or consequential damages arising from your use of the Platform. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.
You may stop using the Platform at any time. We may suspend or terminate access for breach of these Terms, or where required by law. Provisions that by their nature should survive termination will survive it.
We may update these Terms. When we do, we will revise the “Last Updated” date above, and we will give notice within the Platform where the change is material. Continuing to use the Platform after a change means you accept it.
